While the blood alcohol content (BAC) limit of 0.08 is the same for operating a boat as it is for driving a motor vehicle, boating under the influence carries penalties that are different from those associated with driving under the influence (DUI). There are also defenses available in BUI cases that are not applicable in DUI situations. For example, it is possible to successfully defend against BUI charges by showing that the boat in question was moored or anchored.

The penalties associated with BUI charges in Tennessee include:

  • First offense BUI: Fines of $250 to $2,500, a jail sentence of up to 11 months and 29 days, and the suspension of boating privileges for up to one year
  • Second Offense BUI: Fines of $500 to $2,500, a jail sentence of up to 11 months and 29 days, and the suspension of boating privileges for two years
  • Third or Subsequent Offense BUI: Fines of $1,000 to $5,000, a minimum jail sentence of 30 days up to 11 months and 29 days, and the suspension of boating privileges for a minimum of three years up to a maximum of 10 years
